Disabled Beneficiary Trusts can be included in Wills, and are in the best interest of a child, or relative, with disabilities.
The Beneficiary is still able to claim any State / Council care and assistance without the State / Council being able to demand payment from monies in the Trust. These types of Trusts are tax efficient, and, where there is a physical disability, can usually be accessed directly by the Beneficiary, who will also be one of the Trustees. In the case of a mentally disabled Beneficiary, the Trust would generally be the responsibility of trusted friends and relatives.
